Agreement

By subscribing to Illustrious you agree to these terms. Please read them. They are written plainly and we mean them.

What we provide

Illustrious builds and maintains custom websites for real estate agents. Your subscription includes the services listed on the plan you purchased at the time of sign-up. We reserve the right to adjust plan inclusions for new subscribers with reasonable notice.

Website Compliance

Illustrious builds websites with real estate advertising and disclosure requirements in mind, but real estate regulations vary by state and change over time. You are solely responsible for ensuring your site complies with your state real estate commission's rules and your supervising broker's guidelines. If your site needs changes to meet a specific compliance requirement, we're glad to work with you to make them, though we do not guarantee that any site will satisfy all applicable regulations. You agree to obtain your broker's approval before your site goes live. Illustrious is not liable for any regulatory fines, disciplinary action, or MLS penalties arising from your use of the site.

Subscription and billing

Subscriptions are billed monthly through Stripe beginning on the date of purchase. Billing recurs automatically on the same date each month. You authorize us to charge your payment method on file each billing cycle until you cancel.

Prices are as listed at the time of purchase. We will provide at least 30 days notice before increasing prices for existing subscribers.

Cancellation

You can cancel your subscription at any time with no penalty. Your site remains live until the end of the current billing period, then goes offline. We do not issue prorated refunds for partial billing periods.

Client responsibilities

You are responsible for providing accurate information in the intake form. You represent that you have the rights to any photos, logos, copy, and other content you submit to us. You agree not to use your site for any unlawful purpose.

Intellectual property

While your subscription is active, you have full use of your Illustrious-built website under your own domain. Illustrious retains ownership of the underlying codebase and templates. You do not acquire any ownership of the design or code through your subscription.

Availability

We target high availability for all hosted sites but do not guarantee a specific uptime SLA on Basic or Agent plans. We will make reasonable efforts to resolve outages promptly. Planned maintenance will be communicated in advance where possible.

Limitation of liability

Illustrious is not liable for any indirect, incidental, or consequential damages arising from your use of the service, including lost business, lost leads, or downtime. Our total liability to you for any claim is limited to the amount you paid us in the 30 days preceding the claim.

Indemnification

You agree to indemnify Illustrious against any claims arising from content you provided, your violation of these terms, or your violation of any third-party rights.

Changes to these terms

We may update these terms at any time. We will notify you by email of material changes at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Wisconsin. Any disputes will be resolved in the courts of Brown County, Wisconsin.
